论民事诉讼中的举证责任[摘要]民事诉讼中的举证责任，不仅是我国民事诉讼法证据理论中的重要问题，而且是我国民事诉讼司法实践中经常运用的实际问题。正确理解和运用民事诉讼中举证责任，对我们深刻领会我国民事诉讼法的精神实质和正确运用这一理论去指导司法实践具有十分重要的意义。现今民事审判方式改革成为我国民事诉讼法学界的一个热点，在审判方式改革的系统工程中，由于证据制度在诉讼制度中天然的核心地位，因此，证据制度改革的力度最大、改革的进程也最快。证据制度改革的重头戏是举证责任的强化。举证责任的强化和落实从一开始就成为证据制度改革的另一条主线。明确民事诉讼举证责任的概念是构建民事诉讼举证责任理论的基础，西方两大法系在对民事诉讼举证责任含义的理解上虽然存在着一定偏差，但基本上已趋于一致。本文在确定了完整的民事诉讼举证责任的概念之后，并分析了举证责任的内涵和性质。民事诉讼中举证责任的分配原则是举证责任制度的重心，本文阐述了建立在法律要件分类说基础上的民事诉讼举证责任的一般分配原则及其例外，以及特殊情况下的举证责任的免除，并重点根据我国的实际情况，对民事诉讼举证责任制度中现存地问题及完善有关问题提出了相应的立法和司法建议。[关键词]举证责任制度；举证责任的分配；举证责任倒置；结果责任TheburdenofproofincivilproceedingsAbstract:Theburdenofproofincivilproceedings,notonlyisevidenceofChina'sCivilProcedureLawoftheimportanttheoreticalissues,butalsociviljudicialpracticeinChinaoftenusethepracticalproblems.Correctunderstandingandapplicationoftheburdenofproofincivilproceedings,toourprofoundunderstandingofChina'sCivilProcedureLawandthecorrectuseofthespiritualessenceofthistheorytoguidethejudicialpracticeofgreatsignificance.ThecurrentciviljusticereformtheCodeofCivilProcedurebecomeahotacademiccircles,inthetrialreformofthesystemsengineeringapproach,becausetheevidencelitigationsysteminthenaturalsystemoftheUnitedNations,therefore,evidenceofeffortstoreformthemost,theprocessofreformisalsothefastest.Evidenceofamajorreformofthesystemistostrengthentheburdenofproof.Enhancedburdenofprooffromtheverybeginningandfollow-upevidenceonthereformofthesystemtobecomeanothermainline.Aclearconceptoftheburdenofproofincivilproceedingsisthecivilburdenofprooftobuildthebasisofthetheory,theWestTwoLegalburdenofproofincivilproceedings,althoughtheunderstandingofthemeaningoftheexistenceofacertainbias,butbasicallyinline.Inthispaper,todeterminetheintegrityoftheconceptofburdenofproofincivilproceedings,theburdenofproofandananalysisofthecontentandnature.Theburdenofproofincivilproceedingsintheallocationoftheburdenofproofprincipleisthefocusofthesystem,thispaperbuiltonthelegalrequirementsonthebasisofclassification,saidtheburdenofproofincivilproceedingsingeneraldistributionanditsexceptions,andunderspecialcircumstancesfromtheburdenofproof,andfocusontheactualsituationofourcountry,onthecivilburdenofprooftothequestionoftheexistingsystemandimprovetherelatedquestionoftheappropriatelegislativeandjudicialrecommendations.Keywords:Theburdenofproofsystem；Theallocationoftheburdenofproof；Burdenofproof；Theresultsoftheresponsibility目录1举证责任的几个基本问题...................................................................................................11.1举证责任的概念.........................................................................................................11.2举证责任的内涵.........................................................................................................11.3举证责任的法律性质.................................................
