ANNEX1CAGREEMENTONTRADE-RELATEDASPECTSOFINTELLECTUALPROPERTYRIGHTSPARTIGENERALPROVISIONSANDBASICPRINCIPLESPARTIISTANDARDSCONCERNINGTHEAVAILABILITY,SCOPEANDUSEOFINTELLECTUALPROPERTYRIGHTS1.CopyrightandRelatedRights2.Trademarks3.GeographicalIndications4.IndustrialDesigns5.Patents6.Layout-Designs(Topographies)ofIntegratedCircuits7.ProtectionofUndisclosedInformation8.ControlofAnti-CompetitivePracticesinContractualLicencesPARTIIIENFORCEMENTOFINTELLECTUALPROPERTYRIGHTS1.GeneralObligations2.CivilandAdministrativeProceduresandRemedies3.ProvisionalMeasures4.SpecialRequirementsRelatedtoBorderMeasures5.CriminalProceduresPARTIVACQUISITIONANDMAINTENANCEOFINTELLECTUALPROPERTYRIGHTSANDRELATEDINTER-PARTESPROCEDURESPARTVDISPUTEPREVENTIONANDSETTLEMENTPARTVITRANSITIONALARRANGEMENTSPARTVIIINSTITUTIONALARRANGEMENTS;FINALPROVISIONSAGREEMENTONTRADE-RELATEDASPECTSOFINTELLECTUALPROPERTYRIGHTSMembers,Desiringtoreducedistortionsandimpedimentstointernationaltrade,andtakingintoaccounttheneedtopromoteeffectiveandadequateprotectionofintellectualpropertyrights,andtoensurethatmeasuresandprocedurestoenforceintellectualpropertyrightsdonotthemselvesbecomebarrierstolegitimatetrade;Recognizing,tothisend,theneedfornewrulesanddisciplinesconcerning:(a)theapplicabilityofthebasicprinciplesofGATT1994andofrelevantinternationalintellectualpropertyagreementsorconventions;(b)theprovisionofadequatestandardsandprinciplesconcerningtheavailability,scopeanduseoftrade-relatedintellectualpropertyrights;(c)theprovisionofeffectiveandappropriatemeansfortheenforcementoftrade-relatedintellectualpropertyrights,takingintoaccountdifferencesinnationallegalsystems;(d)theprovisionofeffectiveandexpeditiousproceduresforthemultilateralpreventionandsettlementofdisputesbetweengovernments;and(e)transitionalarrangementsaimingatthefullestparticipationintheresultsofthenegotiations;Recognizingtheneedforamultilateralframeworkofprinciples,rulesanddisciplinesdealingwithinternationaltradeincounterfeitgoods;Recognizingthatintellectualpropertyrightsareprivaterights;Recognizingtheunderlyingpublicpolicyobjectivesofnationalsystemsfortheprotectionofintellectualproperty,includingdevelopmentalandtechnologicalobjectives;Recognizingalsothespecialneedsoftheleast-developedcountryMembersinrespectofmaximumflexibilityinthedomesticimplementationoflawsandregulationsinordertoenablethemtocreateasoundandviabletechnologicalbase;Emphasizingtheimportanceofreducingtensionsbyreachingstrengthenedcommitmentstoresolvedisputesontrade-relatedintellectualpropertyissuesthroughmultilateralprocedures;DesiringtoestablishamutuallysupportiverelationshipbetweentheWTOandtheWorldIntellectualPropertyOrganization(referredtointhisAgreementas"WIPO")aswellasotherrelevantinternationalorganizations;Herebyagreeasfollows:PARTIGENERALPROVISIONSANDBASICPRINCIPLESArticle1NatureandScopeofObligations1.MembersshallgiveeffecttotheprovisionsofthisAgreement.Membersmay,butshallnotbeobligedto,implementintheirlawmoreextensiveprotectionthanisrequiredbythisAgreement,providedthatsuchprotectiondoesnotcontravenetheprovisionsofthisAgreement.MembersshallbefreetodeterminetheappropriatemethodofimplementingtheprovisionsofthisAgreementwithintheirownlegalsystemandpractice.2.ForthepurposesofthisAgreement,theterm"intellectualproperty"referstoallcategoriesofintellectualpropertythatarethesubjectofSections1through7ofPartII.3...
