摘要自上个世纪80年代，民事“执行难”问题便困扰我国人民法院。近几十年来，虽然我国司法改革的步伐从未停止，但就最高人民法院每年公布执结数据来看，收到的成效甚微，人民群众的反映仍是不满意，本文就基于此出发，探讨民事“执行难”的成因与对策等问题。本文分绪论、民事执行难概述、民事执行难原因分析与解决民事执行难的对策四章。本文的第一章绪论，笔者对国内外民事执行研究的现状简单的做了评述；本文的第二章，笔者首先提出了对民事执行难的理性界定方式，接下来，笔者归纳总结了21世纪新形势下，民事执行难的表现形式；本文的第三章，笔者从立法、司法、执行环境三个方面剖析了造成民事执行难的原因，其中执法环境的原因包括地方保护主义与社会诚信意识缺失两部分内容；本文的第四章，笔者有针对性地提出了解决民事执行难的对策，即尽快出台强制执行法、改革执行体制与改善执法环境。关键词：执行难；表现；原因；对策TheStudyOntheDifficultyofCivilExecutioninOurCountryAbstractSincethe1980s,theDifficultyofCivilExecutionproblemplaguedourpeople'scourt.Inrecentdecades,althoughthepaceofjudicialreforminChinahasneverstopped,thesituationreceivelittlesuccessandthepeopleisstillnotsatisfiedfromannualdataontheimplementationofviewpublishedbytheSupremePeople'sCourt.Basedonthesituation,thearticleistoexplorethecauses,countermeasuresandotherissuesincivil"difficultimplementation".Thisarticleisdividedintofourparts:introduction,thedifficultyofcivilexecution,thedifficultanalysisofcivilexecutionandthecountermeasurestosolvethedifficultimplementationofcivilaffairs.Inthefirstchapter,theauthorbrieflyreviewsthecurrentsituationofcivilexecutionresearchbothathomeandabroad.Inthesecondchapter,theauthorfirstputsforwardtherationalwaytodefinethecivilimplementationdifficult,thensumsupthenewsituationinthe21stcentury,theimplementationofcivildifficultform.Inthethirdchapter,theauthoranalyzesthecausesofcivilenforcementfromtheaspectsoflegislation,judicatureandexecutionenvironment.Thereasonsoflawenforcementenvironmentincludethelackoflocalprotectionismandsocialsenseofhonesty.Inthelastchapter,theauthorputsforwardthecountermeasurestosolvethedifficultimplementationofcivillaw,thatistoIntroducetheenforcementlawassoonaspossible,reformtheimplementationofthesystemandimprovethelawenforcementenvironment.KeyWords：theDifficultyofCivilExecution；Performence；Causes;Solutions目录摘要.....................................................................................................................................IAbstract......................................................................................................................................II1绪论.........................................................................................................................................11.1研究背景及意义..........................................................................................................11.1.1研究背景...........................................................................................................11.1.2研究意义...........................................................................................................21.2文献综述......................................................................................................................21.2.1国外研究现状...................................................................................................21.2.2国内研究现状.........................................................................
