目论特殊防卫[摘 要] 特殊防卫是指为了使国家、公共利益、本人或者他人的人身权利免受正在进行的行凶、杀人、抢劫、强奸、绑架以及其他严重危及人身安全的暴力犯罪的不法侵害,对不法暴力侵害者实施的即使是造成不法暴力侵害人伤亡后果的损害行为,也不负任何刑事责任的一种情形。特殊防卫的历史源远流长，从商周时期的萌芽到汉代以后的发展再到 1997 年刑法，一直在不断演变。特殊防卫除具备一般防卫的适用条件外还包括“正在进行的行凶、杀人、抢劫、强奸、绑架以及其他严重危及人身安全的暴力犯罪”这一特殊条件。如何理解这一特殊条件是适用特殊防卫的关键所在。[关键词] 正当防卫；特殊防卫；严重危及人身安全；暴力犯罪[Abstract] Special defense refers to the situation that in order to prevent the nation, public benefits, individuals and other personal rights from the invasion of the ongoing assault, murder, robbery, rape, kidnapping and other serious violent crimes endangering personal safety, to take defensive actions, even resulting in criminal violation of casualties, individuals involved or implicated are still not defensive, not criminally responsible. Special defense enjoys a long history. It dates back to the Shang and Zhou Dynasties, witnessed the vicissitudes of dynasties and has been compiled into the 1997Criminal Law. Apart from the applicable conditions general defense has covered, special defense also comprises "the ongoing assault, murder, robbery, rape, kidnapping and other serious violent crimes endangering personal safety".
