保险消费者权益保护中的惩罚性赔偿制度研究【摘要】1993 年,我国颁布《消费者权益保护法》(以下简称《消法》),首次以法的形式体现惩罚性赔偿的理念,到后来的新《消法》、《食品安全法》、《劳动合同法》、《侵权责任法》均对此理念有所体现,但是不系统、不全面。有些领域的立法甚至还未提及,保险行业就是其中之一。目前中国保险行业正在加快转型、追求高质量发展,为了减少因保险合同的射幸性特征和保险人可能违反最大诚信原则所带来的欺骗保险消费者、损害其利益的风险,让惩罚性赔偿制度在保险消费者权益中发挥惩戒、威慑和警告保险人、安抚补偿和鼓励保险消费者的作用是大势所趋。本论文通过案例分析并结合国内外相关经验,联系我国具体实际,希望能为我国保险立法中,将惩罚性赔偿制度纳入保险消费者权益保护提供有价值的建议。【关键词】保险消费者;保险人;惩罚性赔偿制度;欺诈;权益Research on Punitive Compensation System in Insurance Consumers' Rights Protection[Abstract] In 1993, the "Consumer Protection Law" was promulgated in China for the first time to embody the concept of punitive compensation. In the later new "Consumer Rights Protection Law", "Food Safety Law", "Labor Contract Law" and "The Tort Liability Law" reflect this concept, but it is not systematic and comprehensive. Legislation in some areas has not even been mentioned, and the insurance industry is one of them. At present, China's insurance industry is accelerating transformation and pursuing high-quality development.
