摘 要婚姻家庭是一种社会历史的现象。它并不是自始存在、永恒不变的，而是人类社会发展到一定阶段才出现的体现两性和血缘关系的社会形式。婚姻，是指男女两性的结合，并为社会制度所确认的夫妻关系。家庭，是由一定范围的亲属所构成的生活单位，这种亲属关系是其于婚姻关系、血缘关系及至收养关系而发生的。两者是密切联系的，婚姻是产生家庭之前提，家庭是婚姻缔结之结果。婚姻自由原则是婚姻法中的首要基本原则，婚姻自由是法律赋予公民的一项基本权利，本文论述了婚姻自由原则的发展、主要内容，以及婚姻自由在法律和道德方面的相对性。同时，针对当前社会存在的“闪婚闪离”现象、同性恋婚姻、干涉婚姻自由的情况等系列问题提出了自己的理解和建议。[关键词] 婚姻自由 婚姻自由的相对性 闪婚闪离 同性恋婚姻 Abstract Marriage is a social and historical phenomenon.
