I网络直播用工关系的劳动法思考内 容 摘 要网络直播已经逐渐渗透进人们的日常生活中,而网络直播用工也成为新型劳动模式之一,并与传统劳动关系产生碰撞。网络直播的大众化使得网络主播跳槽和直播平台过分限制主播自由的乱象层出不穷。由于现行的传统劳动法无法完全解决主播与直播平台之间的用工关系等问题,虽然我国出台了新的互联网管理规定进行规范管理,仍难以调整处于劳动法灰色模糊地带的直播行业。本文主要研究网络直播用工与传统劳动关系的差异,网络主播与经纪公司之间的关系及用工争议,针对网络直播用工存在的问题提出一些解决措施,我国需要立足直播平台经济发展的现状,规划未来的立法走向,借鉴国外关于新型行业的立法经验,改变劳动法调整模式,拓宽从属性内涵,出台相应的法律法规,实现主播和直播平台的和谐共生。关键词:直播平台;劳动关系;网络直播用工IILabor Law of Network Broadcast Labor RelationsAbstractNetwork broadcast has gradually penetrated into People's Daily life, and network broadcast employment has become one of the new labor modes, and has collided with the traditional labor relations.
