欧 盟 法 中 的 被 遗 忘 权 在 我 国 的 可适 用 性 研 究摘 要被 遗 忘 权 是 欧 盟 提 出 的 新 兴 权 利 ， 指 数 据 的 所有 者 或 者 当 事 人 有 权 利 要 求 数 据 的 掌 握 者 删 除 所含 到 个 人 本 身 的 相 关 主 体 数 据 ， 尤 其 是 在 互 联 网世 界 中 ， 除 非 对 方 提 出 合 理 有 据 的 法 律 理 由 ， 那么 涉 及 到 该 主 体 的 相 关 数 据 应 该 被 遗 忘 或 者 删 除。本 文 认 为 被 遗 忘 权 是 一 种 具 体 人 格 权 ， 是 大 数 据时 代 下 个 人 信 息 权 的 延 伸 。 被 遗 忘 权 对 个 人 信 息保 护 、 个 人 主 体 地 位 重 申 、 网 络 产 业 健 康 发 展 等方 面 存 在 有 利 作 用 ， 但 是 其 与 言 论 自 由 、 公 共 知情 、 网 络 经 济 发 展 、 跨 境 数 据 流 动 的 矛 盾 不 能 被忽 视 。 鉴 于 我 国 开 放 的 人 格 权 体 系 、 现 行 法 律 对个 人 信 息 的 兼 容 性 保 护 ， 被 遗 忘 权 在 我 国 存 在 被适 用 的 可 能 性 ， 因 此 应 对 被 遗 忘 权 在 我 国 的 适 用作 出 具 体 设 计 。关 键 词 ： 被 遗 忘 权 ； 人 格 权 ； 言 论 自 由 ； 个人 信 息 权Study on Applicability of a Right to be Forgotten in EU Law in China ABSTRACTThe right to be forgotten is an emerging right proposed by the European Union.
