1《死者遗产继承法律适用公约》法律适用规则浅析【摘要】海牙国际私法会议在 1988 年通过的《死者遗产继承法律适用公约》所确立的法律适用规则（在确定继承准据法时采取多元连结因素；采用“同一制”的继承制度；选择准据法时引入意思自治原则、最密切联系原则；有限制地采用转致，但排除反致；对于无人承继财产也作了相关规定），对于解决我国有关涉外继承法律适用的立法与实践过程中出现的问题（立法体例不科学和立法内容不周延）具有非常重要的指导意义。通过与《公约》进行对比分析，我国有关涉外继承法律适用的规定可以从以下方面进行完善：采纳科学的法律体例，建立继承与遗嘱分立模式下的“遗嘱”体例；采用“同一制”的继承制度；将不动产所在地法纳入涉外遗嘱继承法律制度的准据法；限制公共秩序保留原则的适用；明确继承准据法的适用范围。【关键词】《死者遗产继承法律适用公约》；涉外继承；法律适用Abstract:The rules for the application of law established by the Convention on the Application of the Law of succession of the deceased, adopted by the Hague Conference on Private International Law in 1988 (adoption of a multi-link factor in determining the applicable law of succession; adoption of a system of succession under the "same system"); When choosing the applicable law, the principle of autonomy of will should be introduced, and the principle of the closest connection should be introduced, and the transfer should be restricted, but the reverse should be excluded.
