北京理工大学珠海学院 2020 届本科生毕业论文案外人执行异议之诉研究案外人执行异议之诉研究摘要案外人执行异议之诉是案件在执行阶段案外人针对可能损害自己权利的不当执行提起异议的诉讼，其目的在于阻止法院的执行，是立法为保证执行的公正合法，赋予案外人的一项救济制度。虽然我国立法规定了案外人执行异议之诉制度，但是依然有填补的漏洞和需要完善之处。本文首先对案外人执行异议之诉的概念及所发挥的功能进行分析，并认为其从性质上应理解为形成之诉。其次，本文对我国的立法和司法实践进行阐述，发觉我国制度存在的不足。最后，本文针对本制度存在的问题提出自己的建议和解决方案。希望我国法律制度日趋完善，执行过程中案外人、当事人的权利得到充分的保护，公平正义不仅体现在每一个案件审理上，也要体现在案件的执行中。关键词：案外人执行异议之诉；形成之诉；案外人权利保护；强制执行北京理工大学珠海学院 2020 届本科生毕业论文Study on the case of an outsider's execution of objectionsAbstractThe action of the outsider in enforcing the objection is the action of the outsider in the execution stage of the case against the improper execution which may damage his rights, the purpose of which is to prevent the execution of the court, and the legislation is a relief system given to the outsider in order to ensure the fairness and legality of the execution.
