论劳动法上的强制性规范摘要:通过对现行劳动法的分析,我们发现由于法律的局限性,我国的劳动法并不能全面的将劳动者的利益纳为强制性规范的范围内,劳动法的真实效应也未能充分得到发挥,其原因主要在于我国的劳动法在实际使用过程中常常因为不能清楚区分强制性规范、公共政策条款、自我限定规范的界限因而出现了混用的现象。想要解决这一问题,理清劳动者与劳动者权利的关系就必须充分分析劳动法体系系统,深刻认识强制性规范的含义。从这一角度出发,本篇文章首先从概念上对强制性规范概念进行了分析,其次对劳动法上强制性规范规定的必要性进行了分析同时对劳动法上的强制性规范做出了解释,旨在理清三者之间的关系为增强劳动法的适用性做出贡献。关键词:劳动法 自我限定规 范强制性规范Abstract: through the analysis of the current labor law, we found that because of the limitation of law, China's labor law is not comprehensive to the interests of workers into scope of mandatory norms, the real effect of the labor law also failed to fully play, the main reason is that China's labor law in the process of actual use often because they can not clearly distinguish the mandatory norms and public policy terms, self limiting boundaries resulting in mixed phenomenon. In order to solve this problem, it is necessary to analyze the system of labor law system and understand the meaning of mandatory norms.
