中美数字贸易博弈研究【摘要】数字贸易作为数字经济发展的重心正受到国际的重视，但是各国为了推进国家数字贸易的发展出台的相关政策和规则却有较大的差异。不管是美国与欧盟国家，还是中国与美国以及欧盟日本等国家都在数字贸易上纷争不断。2019 年中美贸易战使得人心惶惶，尤其是在数字贸易的博弈上更加引起了世界的广泛关注。美国作为世界最发达的国家不仅抓住了数字贸易的时代机遇，且在数字贸易竞争中占有较大的比较优势，因此引领了全球数字贸易的发展。在数字贸易的蓬勃发展中，美国根据自身国情贯彻落实了数字贸易政策，完善了国内数字领域规制体系建设，还主动参与了数字贸易国际规则的制定，推出了成熟的“美式模板”。与美国相比，虽然近年来中国在跨境电子商务等数字贸易方面取得了一定的成绩，但数字贸易的水平仍存在较大发展空间。关于中美数字贸易的博弈则主要集中在数据能否自由流通，消费者隐私和知识产权的保护等发面。为此中国应完善国内数字贸易规制体系建设，加快有关数字贸易的立法；主动参与制定国际数字贸易规则，加快数字贸易的发展，努力构建“中式模板”；积极培育一批优秀数字贸易企业。【关键词】贸易战；数字贸易；数字贸易规则Research on China-US Digital Trade Game [Abstract] As the focus of the development of digital economy, digital trade is being paid attention to by all countries.
