题 目:浅论商品房预售合同总中预购人的风险及利益保障摘 要随着市场经济的繁荣发展,商品房的销售方式也日益多样化,起源于中国香港的商品房预售制度随即在全国范围内兴起。商品房预售制度的兴起虽然在一定程度上缓解了房地产商的资金短缺的问题,但由于这一制度不完善、信息披露制度的不合理、对房屋预售款的监管不到位以及预售方进行虚假的宣传等因素,使得预购人的一些正当权益得不到维护。针对这一系列对房屋的预购人权益侵害的行为,为了更好的维护预售方的正当权益,本文阐述了几点相关建议:完善商品房预售登记制度、制定合理的信息披露标准、强化对预售款使用的监管以及严格管控预售方的广告行为。关键词:商品房预售;预购人权益;风险;原因分析;建议ABSTRACT With the development of market economy, Commercial housing sales are also increasingly diversified . Although the rise of the pre-sale system of commercial housing has alleviated the shortage of funds of the real estate seller to a certain extent, some of the legitimate rights and interests of the pre-buyer can not be safeguarded because of the imperfect system, the unreasonable information disclosure system, the inadequate supervision of the pre-sale of housing and the false propaganda of the pre-sale party. In order to better protect the legitimate rights and interests of the pre-sellers, this paper expounds several relevant suggestions: perfecting the pre-sale registration system of commercial housing, establishing reasonable information disclosure standards, strengthening the supervision of the use of pre-sale funds and strictly controlling the advertising behavior of the pre-sellers.
