浅析吉林省工伤保险制度的困境与突破摘 要工伤保险是劳动者在工作的过程中或是规定的时间内,发生意外伤害或者得了职业病时,导致暂时或者永久丧失劳动能力时,为劳动者或者其家属提供一定经济补偿的一项社会保险制度。工伤保险制度是社会保障制度的一个重要组成部分,由国家通过立法强制实施。建立工伤保险有利于促进安全生产,保护和发展社会生产力,是国家对职工履行的社会责任,也是职工应该享受的基本权利无论是对用人单位还是职工都有着非常重要的意义。虽然工伤保险制度到现在已经发展了数十年的时间了,也建立起了三位一体的工伤保险制度,但是目前我国的工伤保险制度还存在很多不足之处。本文以吉林省为例,就吉林省工伤预防功能发挥不足、工伤保险参保情况不够理想、工伤补偿忽略了劳动者的精神损害工伤康复落实不到位这四个问题进行讨论,分析原因并给出对策和建议,改变吉林省工伤保险不够成熟的现状使其更加完善。关键词:工伤保险 精神损害 预防 工伤康复AbstractIndustrial injury insurance is a social insurance system that provides certain economic compensation for workers or their families when workers suffer from accidental injuries or occupational diseases in the process of work or within the prescribed time, resulting in temporary or permanent incapacity to work.
