我国代位继承制度的特点和完善

我国代位继承制度的特点和完善学摘 要代位继承，是和本位继承相对应的一种继承制度，是法定继承的一种特殊情况，是公民私人财产顺利转移的重要法律依据。本文针对我国代位继承中存在的主要问题及其产生原因，提出一系列的立法建议来完善我国的代位继承制度，以适应时代的发展需要，实现公民的私人财产继承权得到足够的保护。关键词：代位继承；存在问题；产生原因；立法完善 ABSTRACTSubordination inheritance, which is a kind of inheritance system corresponding to the standard inheritance, is a special case of legal succession and an important legal basis for the smooth transfer of private property of citizens.
